Paradoxically, the current legal status of the Donbas republics allowed Russia to mobilize many more there than in actual Russian territories. Since Donbas is not legally part of Russia, local governments there were able to go full on mobilization, mobilizing upward of 50 thousand, some say even over 100 thousand troops. For an area where 4 million people live, that's possibly 2.5% of population mobilized. That's roughly on par with what Ukraine mobilized, percentage wise.

If the area becomes part of Russia proper, legally, and if Russian laws don't change, it may become harder to keep those forces mobilized.

However if it's legally part of Russia, then conscripts from the rest of Russia can be deployed there without a declaration of war.

Nothing will change. Ukraine already attacked Russian proper.
Russia had still used just peace time army. Now it would start at least partial mobilization. Tommorow Duma(it is already announced) would pass laws changes about mobilisation and different terms tied to it. It would be war now.

Russia would start mobilisation now(at least partial). Duma had passed laws about it(there is whole list with prison terms for different violations in war time etc etc). It is all-out war after referendums.

I find all this legality talk perplexing, this is a life or death issue for Russia and they're limiting themselves on whether it is legal to send conscript? Is it a joke? I mean Russian has never been a super law abiding people in the first place.

I think you do not get two things:

1) Russia always was bureaucratic. It is massive empire. You cannot exist with such size without bureaucracy.

2) Until now it was peace time army in the format of special operation. According to CIA it is 100-150k troops plus around 50k of LNR-DNR. It is not just conscripts, even army guys could have rejected orders to participate in operation legally. Now it look like to change really soon.


LNR and DNR had annonced referendums from 23 to 27 of September.
