TE has this one anchored here folks, this is not the A team, this is some little flunky thinking this will get them into the big-league on human rights, and earn a pat on the back from the "boss", unfortunately this teams foreign policy has been one major screw up after another, NO ONE on this team has a clue what "diplomacy" is about, they think that is an archaic board game like "parchesi".

WASHINGTON (AP) — President Barack Obama intends to nominate Sen. Max Baucus, D-Mont., as ambassador to China, Democratic officials said Wednesday, turning to a lawmaker well-versed in trade issues to fill one of the nation's most sensitive diplomatic posts.

If confirmed by the Senate, Baucus would replace Ambassador Gary Locke, who announced last month he was stepping down.

An announcement of Baucus' appointment is expected as early as Thursday.

The Montanan's departure from the Senate would have an instant impact on one of Congress' most powerful committees and on the 2014 election for control of Congress. Under state law, Democratic Gov. Steve Bullock has the authority to name a Senate successor to serve until the election, and speculation immediately turned to a fellow Democrat, Lt. Gov. John Walsh, already a candidate for a full term.

Baucus, 72, sidestepped questions about the ambassadorship when asked in the Capitol. "It's not for me to comment on. ... This happens every once in a while. Names get floated around."

There was no immediate comment from the White House on the disclosure, which was made by officials who spoke on condition of anonymity because they were not authorized to discuss the nomination publicly before a formal announcement.

Kathy Weber, a spokeswoman in Baucus' office, declined to confirm the move but said, "Max has given his life to public service and when asked to serve he takes that request very seriously."

Obama is in search of a new top diplomat in Beijing as he executes a so-called Asia pivot in U.S. foreign policy to more directly counter China after the wars in Iraq and Afghanistan.

The relationship between the two nations has grown more troubled in recent weeks, with Chinese authorities unilaterally declaring an air defense zone over disputed islands in the East China Sea. The United States subsequently flew a pair of B-52 bombers through the space last month without incident, and Vice President Joe Biden sought to calm matters on his recent trip through Asia.

Baucus was first elected to the Senate in 1978 and since early 2007 has been chairman of the Senate Finance Committee, which has jurisdiction over taxes, trade, health care and more.

On some key issues, he has pursued a more moderate approach than some fellow Democrats would prefer, a reminder that he hails from a rural, Western state with a history of electing Republicans as well as Democrats to top political office.

Shortly after becoming chairman, he led the opposition to then-President George W. Bush's proposal to privatize Social Security.

Two years later, with Obama in the White House, he struggled for months to assemble bipartisan backing for health care legislation in 2009 to the growing impatience of fellow Democrats. He managed to gain one Republican vote for legislation that cleared committee, but the final bill was thoroughly partisan.

As committee chairman, Baucus has pressed both Democratic and Republican administrations to take a harder line against what he says are unfair Chinese trade practices. The country has the largest trade surplus of any nation with the U.S. and American manufacturers claim it is manipulating its currency to maintain that imbalance.

Inside the Senate, Baucus' appointment would create a vacancy atop the panel that Senate Democrats would fill. Sen. Jay Rockefeller of West Virginia is immediately behind Baucus in seniority and ordinarily would ascend to the chairmanship but has announced he intends to retire at the end of next year. Sen. Ron Wyden of Oregon is next in line in seniority.

In comments to reporters, Rockefeller indicated he would not seek to claim the spot, saying it would be good if Wyden succeeded Baucus. "I want that committee to be a little more aggressive and he will be," he said.

Wyden is chairman of the Energy Committee and would likely be replaced there by an oil state Democrat, Sen. Mary Landrieu of Louisiana.

If confirmed before the end of next year, Baucus would resign his seat and create a vacancy that Montana Gov. Steve Bullock, a Democrat, would fill. Walsh, the lieutenant governor, has announced he will run for the seat and will likely be a top candidate.

First-term Republican Rep. Steve Daines has announced his candidacy for the seat.

With Democrats struggling to retain their majority in the 2014 elections, Baucus' announced retirement had turned the state into a challenging one for the party. Obama lost the state in 2012 to Republican Mitt Romney by 13 points.

To be fair the Indian diplomat is not the innocent naive sweet thang brutally traumatized by uncouth US federal marshalls. As with 99% of stories ever told by human beings... you have her side, your side and then you have the real truth.

FOR IMMEDIATE RELEASE Wednesday, December 18, 2013
There has been much misinformation and factual inaccuracy in the reporting on the charges against Devyani Khobragade. It is important to correct these inaccuracies because they are misleading people and creating an inflammatory atmosphere on an unfounded basis. Although I am quite limited in my role as a prosecutor in what I can say, which in many ways constrains my ability here to explain the case to the extent I would like, I can nevertheless make sure the public record is clearer than it has been thus far.

First, Ms. Khobragade was charged based on conduct, as is alleged in the Complaint, that shows she clearly tried to evade U.S. law designed to protect from exploitation the domestic employees of diplomats and consular officers. Not only did she try to evade the law, but as further alleged, she caused the victim and her spouse to attest to false documents and be a part of her scheme to lie to U.S. government officials. So it is alleged not merely that she sought to evade the law, but that she affirmatively created false documents and went ahead with lying to the U.S. government about what she was doing. One wonders whether any government would not take action regarding false documents being submitted to it in order to bring immigrants into the country. One wonders even more pointedly whether any government would not take action regarding that alleged conduct where the purpose of the scheme was to unfairly treat a domestic worker in ways that violate the law. And one wonders why there is so much outrage about the alleged treatment of the Indian national accused of perpetrating these acts, but precious little outrage about the alleged treatment of the Indian victim and her spouse?

Second, as the alleged conduct of Ms. Khobragade makes clear, there can be no plausible claim that this case was somehow unexpected or an injustice. Indeed, the law is clearly set forth on the State Department website. Further, there have been other public cases in the United States involving other countries, and some involving India, where the mistreatment of domestic workers by diplomats or consular officers was charged criminally, and there have been civil suits as well. In fact, the Indian government itself has been aware of this legal issue, and that its diplomats and consular officers were at risk of violating the law. The question then may be asked: Is it for U.S. prosecutors to look the other way, ignore the law and the civil rights of victims (again, here an Indian national), or is it the responsibility of the diplomats and consular officers and their government to make sure the law is observed?

Third, Ms. Khobragade, the Deputy General Consul for Political, Economic, Commercial and Women’s Affairs, is alleged to have treated this victim illegally in numerous ways by paying her far below minimum wage, despite her child care responsibilities and many household duties, such that it was not a legal wage. The victim is also alleged to have worked far more than the 40 hours per week she was contracted to work, and which exceeded the maximum hour limit set forth in the visa application. Ms. Khobragade, as the Complaint charges, created a second contract that was not to be revealed to the U.S. government, that changed the amount to be paid to far below minimum wage, deleted the required language protecting the victim from other forms of exploitation and abuse, and also deleted language that stated that Ms. Khobragade agreed to “abide by all Federal, state, and local laws in the U.S.” As the Complaint states, these are only “in part” the facts, and there are other facts regarding the treatment of the victim – that were not consistent with the law or the representations made by Ms. Khobragade -- that caused this Office and the State Department, to take legal action.

Fourth, as to Ms. Khobragade’s arrest by State Department agents, this is a prosecutor’s office in charge of prosecution, not the arrest or custody, of the defendant, and therefore those questions may be better referred to other agencies. I will address these issues based on the facts as I understand them. Ms. Khobragade was accorded courtesies well beyond what other defendants, most of whom are American citizens, are accorded. She was not, as has been incorrectly reported, arrested in front of her children. The agents arrested her in the most discreet way possible, and unlike most defendants, she was not then handcuffed or restrained. In fact, the arresting officers did not even seize her phone as they normally would have. Instead, they offered her the opportunity to make numerous calls to arrange personal matters and contact whomever she needed, including allowing her to arrange for child care. This lasted approximately two hours. Because it was cold outside, the agents let her make those calls from their car and even brought her coffee and offered to get her food. It is true that she was fully searched by a female Deputy Marshal -- in a private setting -- when she was brought into the U.S. Marshals’ custody, but this is standard practice for every defendant, rich or poor, American or not, in order to make sure that no prisoner keeps anything on his person that could harm anyone, including himself. This is in the interests of everyone’s safety.

Fifth, as has been reported, the victim’s family has been brought to the United States. As also has been reported, legal process was started in India against the victim, attempting to silence her, and attempts were made to compel her to return to India. Further, the Victim’s family reportedly was confronted in numerous ways regarding this case. Speculation about why the family was brought here has been rampant and incorrect. Some focus should perhaps be put on why it was necessary to evacuate the family and what actions were taken in India vis-à-vis them. This Office and the Justice Department are compelled to make sure that victims, witnesses and their families are safe and secure while cases are pending.

Finally, this Office’s sole motivation in this case, as in all cases, is to uphold the rule of law, protect victims, and hold accountable anyone who breaks the law – no matter what their societal status and no matter how powerful, rich or connected they are.

She had her maid's family arrested in India because the maid wanted to work outside due to her low wage.

March 2013: Problems started with Richard, according to Dr Khobragade's lawsuit against her in the Delhi high court. It said that Richard wanted to work outside on her off days, but she was told that it was illegal according to her visa status, and also because she had an official passport.

June 23: Richard left DR Khobragade's home to buy groceries, and did not return. Dr Khobragade informed the matter to the consulate general, who informed the concerned authorities.

July 8: Richard visited an immigration attorney's firm in Manhattan, New York. A person present there told Rediff.com then that four individuals from the consulate soon arrived at the attorney's office.

There were discussions, and reports indicated Richard demanded a sum as her wages, and an ordinary Indian passport.

Meanwhile, her husband and child in India were taken into custody, according to the witness. A scared Richard spoke with them, and refused to leave the attorney's office premises.

The consulate officials remained outside. Later in the evening, the police were called and they took Richard away.

The Indian government revoked Richard's official passport the same day, which made her status illegal in the US.

The Indian embassy in Washington, DC requested the US State Department to locate Richard and return her to India.

(Reuters) - China is to send a military ship to help protect a specially adapted U.S. vessel that will destroy Syria's chemical weapons arsenal, the Foreign Ministry said on Thursday.

Syria is due to hand over deadly toxins which can be used to make sarin, VX gas and other lethal agents under an international agreement forged after an attack on the outskirts of Damascus killed hundreds in August.

The chemicals will be destroyed on board the specially adapted U.S. ship because they are too dangerous to import into any country. There is no agreement yet on where the ship will anchor while the work is carried out...

I think President Obama picked him for this position because of his experienced in trades and finance, especially in a country like China.

There is a lot more to this than meets the eye...both on the part of the specific actors, and on the overall geo-political front.

Here's another issue that pre-dates the New York one where the Indian government has detained a US owned, private security vessel that was conducting anti-piracy activities in the IO:

BBC News reports that although no charges have been filed against the crew, under Indian law they should be charged or released within 90 days, and only two weeks remain of this period.

The MV Seaman Guard Ohio, which is owned by Virginia-based AdvanFort, was stopped by Indian authorities on October 11 and was being held in the southern port of Tuticorin along with its 10 crew and 25 armed security guards.

In a statement released by Advanfort Wednesday, the company called the High Court ruling “outrageous” and an “affront to the basic standards of justice”

“The mystifying investigation by Indian authorities has dragged on for two months already while AdvanFort’s seamen and maritime security contractors continue to languish in despicable and barbaric conditions at Indian prisons,” the statement read.

It continues: “Throughout their careers and this ordeal, these men have admirably adhered to the highest standards of professional conduct and integrity. AdvanFort thanks their loved ones for their patience and understanding as we now redouble our efforts in continuing to work around-the-clock, 24/7 to secure their release.”

The MV Seaman Guard Ohio was conducting anti-piracy in the region when it was detained.

The 35 crew are made up of British, Estonian, Indian and Ukrainian nationals.

Lot more going on than meets the eye. Perhaps now the US has something to negotiate for the release of those 35 crew members. At the same time...it should never have come to this on either side. The US had been making huge progeress with India in terms of bilateral ties. I just think the Obama administration has been a disater on foreign affiars across the board.

I lived in Montana for several years. Max Baucus is a complete ideological neophite. Thank goodness in MOntana at the time, we had a counter to him in the Sneate and they in essence cancelled each other out. But Baucus was selected because of his absolute and complete political loyalty, irrespective of the consequences of the poltical plans they have.

Just read that quote you included, and think about what has happened to US Health Care, trade, finance, and the economy since 2007. I wouldn't put any of the people who have been in charge of those things in the last 6 years in charge of ANYTHING critical.

Unelss of course you want them to make as big a mess of that thing as they have of those others.
