You got me on this one. Is LOI relevant? Should there be one?

Of course, it becomes the basis of all negotiation showing the scope and level of sincerity(seriousness) towards that project.
For example In BtoB transaction there is no fix price and all estimates are calculated individually. The LOI becomes the basis for that estimate.

I think you are front running events. As I explained in earlier post, a LOI is premature because events especially in Australia is not at a stage where a LOI is imminent. Tony Abbot might have unnecessarily created such an impression but clearly from the Australian end no one is even remotely describing events as any where near what you are suggesting. The reality is that we are still in the determination phase and that means anything and everything is still on the table.

I have to acknowledge the Abbot government is badly managing this whole process. I can understand the anger from the Japanese end.

Australia's procurement process is probably going to require a lot of study, negotiation with various potential manufacturers, and involvement with the legislature.

It is not uncommon for a large military project to be awarded to an entity that has shown to the military and legislative body's satisfaction that their proposal is really the only one that makes good military and budgetary sense.

Many times, this is not so clear and a tender will be made for the various companies to make proposals to prove who is the best based on performance, ultimately of their prototypes.

I believe that the Japanese submarine would be the best solution for Australia...but even though technically and militarily that may be the case...there is still the need for it to fit politically. Most politicians will want to do what is right and best (normally...but not always), but will also have that desire influenced heavily by the re-election prospects.

I believe Abbott's comments about Australian shipbuilders was purely political and from that quarter. That type of thing is something that the Japanese or anyone else will have to make allowances for...and try to help with...otherwise, without that consideration...any deal is likely to be stillborn.

Major negotiations can be tricky and fluid for a good number of times even with friends and allies, as there are also competitors lurking with thier offers. Nothing is certain until the contracts are signed on the dotted line. That too depends on goodwill and relationship. An example is the French "Mistral" contract with the Russians. In biz 2 important sayings are noted: 1. A sale is not a sale until payment is received in full. 2. In God we trust all others pay cash (or at least equivalent returns).

There was a signing on June 11th 2014, last year during the two + two negotiations between the two nations.
