Judging by his statement the patch is solely made for people with Military Field Experience, Tactics Capabilities and Military Tactics School/Course that promotes Special Force tactics and training. Similar to American Special Force Veterans who has their own brands and promotes their training.

But in this case we could say this is the punisher skull sort of situation where independent allowance doesn't limit soldier from wearing Insignias that expresses them except as of nowdays generation of course.

So this was never an official Chinese military patch. It started out as a commemorative patch given by BACKTHRUST回马枪 (a tactical instructor in the private sector) to soldiers who completed his training course. Now anybody can buy the patch on Taobao for $18.95, including Airsoft™ warriors, cosplayers, and those who have no military experience.

The way you originally presented the information made it sound like the patch was officially issued by the Chinese military. Please provide more context next time to avoid possible confusion.

Errr, it seems PLA have recently issued a request for tender for spiked poles:

A batch for 2600, to be delivered on 27th of Feb. Of note that there's a requirement that it be electrically insulated and tested for insulation, then outside of the insulation it then needs a second layer of heat shrink wrap.
