You are repeating yourself over and over again with the same crappy argument from /r/localllama.
Individuals aren't going to get to interpret what is or is not American; the US government will, and the US government will exclude those fine tunes as American, simple as that. If a business wants to claim the cost of tokens as business expense, it better has receipts from Anthropic and OpenAI. Otherwise, that business is going to have some explaining to do regarding the cash flow discrepency.
In that case, the business will get to pick the poison of coming clean for using non-certified LLMs, or get investigated for, let's say, money laundering.
The onus of proving compliance will rest on the businesses, not the government. The US government also doesn't need to go after every single business that uses LLM. Merely going after those on the S&P500 would be enough to cause the money to be funneled back into the AI bubble.
You are too focused on what the US could do without considering the costs and ramifications of it doing all that.
The most obvious and likely immediate business response to this kind of draconian regulatory efforts would be the TikTok-fixation of international companies with operations in the US where their parents either spin-off or sell-off their US operations to operate independently at arms length from the rest of their corporate interests. Which is the opposite of what US AI companies want and need, because having a walled garden is of no use if that garden is too small to sustain your needs. If US AI gets locked into its home market, then its dead and the only question left is how long the death spasms will last.
For the US to try to use long arm jurisdiction bullshit to pull the EU into its walled garden will either result in a trade war with the EU over it, or they drag the EU down with them if they succeed.
This choice to go all in on AI would have been made sometime around 2023 during Biden presidency. Back then if they went for Star Wars 2.0:
1. Unlike AI which is spread out across many companies, US leading space effort is almost entirely concentrated in SpaceX, particularly back in 2023.
2. The rift between Musk and the democrats were already clear by 2023, so it would have been politically unacceptable for the ruling party.
So going for Star Wars 2.0 seems unlikely in retrospect. Maybe if Musk and his DOGE department hanged around longer after 2025 he could have changed direction, but alas turns out Musk was no good at Washington politics.
Agreed. I find myself thinking back on the movie. I love when a movie has a strong enough impact on you so you continue to think on it after you’ve left the theatre.
