When talking about law in China, we have to consider how much the defendant can pay to the victims and society.
By paying money people can essentially buy off part of their sentence, this is most often seen in corruption cases.

In the past an official had been sentenced to death for taking as little as 200,000 RMB in bribe whereas others survive even when taking millions, this is because the guy spent all his money and could not pay up. Of course the threshold is higher in recent years, but the general idea remains the same, your life will be spared if you can pay up and repair the damage you did to society.

It's the same idea with Xu Ting, I bet he couldn't pay back the money he took that's why he got such a harsh sentence.

Also drinking and driving is very serious offense compared to speeding, they might seem the same but judges are almost unanimously harsher on the former case.

driving under the influence and hit-and-run carry stiffer sentences here in the states too. granted, i do believe a life sentence for vehicular manslaughter is too stiff.

a case like this can be seen as either a simple traffic accident (5 year) or endangering public (life sentence), the power to decide which one to use is with the judge.

Is that how it works in China? I think in most places that job would fall on the prosecutors, while the judges only decide guilty/not guilty based on the evidence presented.
