If such would be “surprise sex” enthusiasts want to test Chinese society, I remember back in the 2000s of pictures depicting an angry Chinese mob chasing down an African rapist and cutting off his member and beating him bloody. If for whatever reason, Chinese law fails the people, the people’s justice will self correct one way or another. Unlike Europe and Britain especially, the judiciary is not corrupt in allowing rape free passes to certain demographics.That is an explicitly established trigger, but in the case of rape, ‘aggregating factors’ is listed as a possible way to elevate the punishment to death but is not explicitly described.
Under Article 48 of the Criminal Law, the death penalty applies only to those who have committed “the most heinous crimes.” Courts have wide discretion in deciding what meets that standard, so don’t expect to be able to try to weasel out of it on a technicality as you can in western and Indian courts. And the expected level of widespread public outrage to Indians doing the most Indian crime in China is almost certain to generate, I would not rate the survival chances of any Indian moronic enough to test that law.
Reminder that during the Obama years when Chinas supercomputer “Milky Way” beat the U.S. super, Obama immediately sanctioned Chinese access to American chips. Now….watch as American companies lose access to Chinese chip market if not the rare earths needed to make those chips.
