1. Able to exceed Mach 5 in atmosphere or near space
2. Must be able to maintain sustained controllable flight at Mach 5
3. Can make large irregular manoeuvres
I quite like the definition because together they rule out the WELL ACKCHYUALLY cases with ICBMs were they exceed the speed as part of their suborbital flight without the manoeuvrability requirement being met.
