Yeah, but some lawyers believe they can still fight it on 1st Amendment grounds. Since the gov is trying to prevent people a means of communicating. Basically , if they try banning it, someone will file an injunction and it would still take months/years for it to happen.
US gov't has a check-and-balance system between Executive (President), Legislative (Congress), and Judicial (Courts)....
so if TikTok wanted to legally challenge the RESTRICT act, it can bring it up to the Supreme Court and say it is "Unconstitutional violation of First Amendment" protection of freedom of speech, since it's excessively broad mandate allows it to regulate and ban digital speech or platform. As @daifo noted, it might consume years and years and years before it gets heard in Supreme Court, so then TikTok can still be operating. I predict TikTok will still operate and get even more popular since it's getting free coverage by the media.
Given that the supreme court is majority republican and the fact that TikTok is a bipartisan issue. I'm certain that the supreme court will make some bullshit excuse to get it banned.
